法官閣下:
從小我父母便教我要有同理心,要關顧社會上相對不幸的人。儘管在早年職業生涯上取得不俗成就,但我從來沒有意欲將追求個人財富視為人生目標。
當我在國外生活了多年後回到香港定居時,我為這個我自豪地稱之為家的城市,存在如此嚴重的社會不平等而感到困惑和擔憂。 令我震驚的是,社會如何漠視對窮人和少數族裔的歧視。既有的社會結構,有時甚至會鼓勵這種歧視繼續發生。同時,我們也無法一如其它地方,享有基本的民主權利和自由。
這些都是我參與社會運動以至參與政治的動機。我希望盡己所能,為被忽視的弱勢階層鼓與呼,替不能為自己發聲的人說話。
與許多人相比,我很幸運能夠接受良好教育,並擁有一定程度上的財務自由和社會地位。我們很幸運,能夠過上舒適生活,並有自由選擇我們的道路。我選擇為社會平等而奮鬥。其實這個法庭上許多人都差不多,我們都喜歡香港,這個稱為家的地方。或許我們在生活中選擇了不同的角色,但目標都是相同:為他人服務。
可悲的是,我擔心我們已經逐漸成為社會制度中的例外。當下許多香港人根本沒有那些機會,包括貧困長者,欠缺向上流動機會、被邊緣化的年輕人,還有犧牲所有時間但只能為家庭僅僅維持基本生活的工人。這些人再努力,生活中的選擇仍然局限於維持生計。對他們來說,「選擇」是負擔不起的奢侈品,更不用說如何決定自己的命運。
在生活壓力下,我們的視野通常很難超越自身的社交圈子,更難的是對陌生人展現同理心。兩極化的政治分歧產生越來越多裂痕,令我們有時候無法互相理解、和而不同,亦不願意試圖尋求某種程度的妥協。
我一直希望,一個較民主的制度能夠成為一道橋樑,彌合上述社會鴻溝,或者至少容讓我們選擇怎樣共同生活。
2019年的動盪,為整個社會帶來了沉重的打擊。無論政治立場如何,我敢肯定這個法庭上有許多人,都為此而傷心欲絕。整座城市都被不信任、仇恨和恐懼所淹沒。今天固然不是討論這個問題的合適地方,但我希望法庭能夠理解,僅靠司法機構並不能解決已經根深蒂固的社會政治鴻溝。
我們需要集體力量、勇氣、誠實和同理心來修補我們的家。看看幾位同案被告,他們在服務社會方面有著非凡的紀錄。比起囚禁在監獄,我相信他們能夠對社會作出更大貢獻。
為了追求全體香港人的權利,我的確違反了法律,並且已準備面對法院的判決。令人敬重的幾位同案被告,畢生捍衛法治,為民主而戰,為無聲者發聲,我十分榮幸能夠與他們並肩同行。
我相信終有一天,籠罩我們城市的烏雲將會消散,光明將會重臨,愛和同理心將會戰勝歸來。

Your Honour,
I was brought up by my parents to value the importance of empathy, to care and to feel for others in our community less fortunate. Although I enjoyed great success early in my career, I never had a desire to pursue personal wealth in the more traditional sense.
When I settled back in Hong Kong after years of living abroad, I was baffled and disturbed by how severe the social inequality existed in a city I am proud to call my home. I was struck at how discrimination against the poor and the minorities far too often goes ignored or can even at times is encouraged by the established social structure; and how we cannot have the basic democratic rights and freedoms that other places enjoy.
These were my motivations to join social activism and enter into politics. I chose to spend my energy to speak for the underprivileged, the disenchanted and often ignored segments of society. To offer a voice for those who could not speak for themselves.
Compared to many, I am privileged to have a great education and a certain level of financial freedom and social standing. We are fortunate enough to be able to lead comfortable lives and have the freedom to choose the path that we take. I chose to fight for social equality. Many of those in this court are not that much different. We all love Hong Kong, the place we call home. We chose our different roles in life but with the same aim: to serve others.
Sadly, I fear that many of us are increasingly the exception to the rule. Today far too many Hong Kong people do not have that chance, whether that is our elderly who live in poverty, marginalized youth with few opportunities for social mobility, or workers who give up all their time slaving away to provide the bare minimum for their families. These people all struggle to make ends meet with very limited options in life. “Choice” for them is a luxury that they cannot afford. Let alone having the gratification of being able to dictate their own destiny.
I recognise, with the pressures of life, it is often difficult for people to see beyond their own social bubble. It is harder still to acquire empathy for strangers. Polarized political division increasingly has driven a wedge between people, making it sometimes impossible for people to understand and empathise with one another, to disagree agreeably, and attempt to find some level of compromise.
It has always been my hope that a more democratic system could be the bridge that heals this social divide or at the very least allow us to choose how we can live together in our home.
I’m certain that none of us in this court wanted to see the turmoil in 2019, which has seen our whole society suffer regardless of political preference. Distrust, hatred, and fear has engulfed Hong Kong. Today is certainly not the right forum for this immense topic. However, I hope the court can understand that the Judiciary alone cannot resolve the deep-rooted socio-political divide which exist.
It will take our collective strength, courage, honesty, and empathy to mend our home. Looking at my fellow defendants with their extraordinary history in serving this society, I believe they can do far greater good among us in society than being locked in prison.
In pursuit of the rights of all Hong Kong people, I have broken the law. I am prepared to face the court’s judgement. I am proud to be in the company of my esteemed fellows who have spent their lives championing the rule of law, fighting for the democracy and voicing for the voiceless.
I believe the storm-clouds that currently reside over our home will one day lift, and make way for a bright and clear day. I believe love and empathy will eventually prevail.

His Holiness the 17th Gyalwa Karmapa shares a teaching on compassion. Compassion is one of the fundamental teachings of Buddhism, about which Karmapa often speaks.
聖陛下第十七世嘉華噶瑪巴大寶法王分享了一個關於慈悲心的教導。慈悲心是佛教的基本教義之一,噶瑪巴經常提到這些教義。
“Compassion is our inherent nature and a quality of our minds. It simultaneously aims towards the true happiness that is inherent in all of us and it wishes to end confusion for everyone, thus enabling a correct understanding about the world and its beings. Through a very natural outflow of compassion, we give substantial meaning to life.
“慈悲心是我們內在的本質和我們心識的品質。它引導我們得到與生俱來的真正幸福,同時它也希望結束每個人的困惑,從而能夠正確理解世界及其眾生。通過一種非常自然的慈悲心的流露,我們為生命賦予了真實的意義。
Since this quality of compassion is inherent, we don’t have to look anywhere else to find it. Wherever there is a consciousness, there is a seed of compassion. It is the same for wisdom. Wherever there is a consciousness, there is a seed of wisdom, too. Compassion is inseparable from wisdom.
由於慈悲心的本質是固有的,我們不需要去其他地方尋找。只要有意識,便會有慈悲心的種子。智慧也是一樣。只要有意識,便會有智慧的種子。慈悲心與智慧是分不開的。
The free flowing expression and quality of compassion is so important, for without it we will not be able to live our lives fully. Without it we will only be able to experience a fragile, conditioned peace. It is due to compassion resulting in true understanding that we can find unconditioned peace and happiness, and ultimately liberation.
自然流動地表達慈悲心和其品質是非常重要的,因為沒有它,我們將無法完全充實地過活。沒有它,我們只能經歷一個脆弱的,有條件的平和。這是由於慈悲心導致真正的理解到我們可以找到無條件的平和與幸福,並最終達至證悟。
To approach this, the Buddha taught us to cultivate more compassion in ourselves, towards each other and the world by recognizing that the aspiration and motivation to want happiness (and not want unhappiness) is deeply rooted in all of us. If we use this understanding to connect with each other, we could create the basis to develop and cultivate what is most essential in our lives: compassion.
為了解決這個問題,佛陀教導我們長養更多對自己,對彼此和世界的慈悲心,做法是通過認識到發願和渴望得到幸福的動機(而不要不快樂)深深紮根於所有人之中。如果我們利用這種理解來相互聯繫,便可以發展和培養生活中最重要的要素:慈悲心
By sowing seeds of compassionate understanding as each moment passes, we are able to overcome various kinds of confusion without much struggle. Obstacles are easily avoided and we advance safely along the path of virtue, making great use of this precious and fragile human existence. For example, in the midst of obstacles, by focusing on our innermost wishes, this will help us to overcome arising mental and physical challenges.
每一刻通過慈悲地理解的種子,我們能夠不大費勁地克服各種困惑。我們能夠容易地避免障礙和沿著善行的道路安全地前進,而且充分利用這個珍貴而脆弱的人生。例如,在障礙中,通過專注於我們最深切的祈願,這將有助於我們克服身心方面的挑戰。
We should remind ourselves that this cultivation of compassion can be achieved without much hard work. We can cultivate compassion while sitting, walking, or even sleeping. By applying ourselves in this way, we can utilise every spare moment to cultivate compassion, even within this limited physical world.
我們應該提醒自己,可以在日常輕鬆的情況下長養慈悲心。我們可以在坐著,走路,甚至睡覺時長養慈悲心。通過這種方式,即使在這個有限的物理世界中,我們也可以利用每一個空餘時間長養慈悲心。

'Wherever there are world systems and beings,
May I be like the lotus, not clung to by water,
And the sun and the moon, unhindered in the sky.'
‘諸惑業及魔境, 世間道中得解脫, 猶如蓮花不著水, 亦如日月不住空’
The lotus flower is used as a metaphor to illustrate the bodhisattva's conduct along the path. Bodhisattvas are not far removed from sentient beings. They don't live in mountain caves, but are very close to all beings and always have the desire to help and liberate them. Lotuses have their roots in dirty mud, but yet, their pure white blossoms remain pristine and untouched by the mud. In the same way bodhisattva practitioners along the path are not contaminated by the habitual tendencies and karma of the sentient beings that they are trying to liberate.
蓮花是用來比喻在修道上菩薩的行為。菩薩不是遠離眾生的。他們不是住在山洞裡面,而是很貼近一切眾生,並恆常地希望幫助和讓他們解脫。蓮花生於淤泥,但是,它們純白的花朵保持潔淨和不沾泥。同一方式,在修道上的菩薩不受他們幫助解脫的眾生的習氣和業所沾染。
If we harbor no hatred, no anger toward another sentient being, and the motivation for our actions is rooted in bodhicitta, then even in times of aggression we can still attain enlightenment, because our activities are uncontaminated by any affliction. With genuine bodhicitta in our mind, we do not hope for any return for our deeds, such as wanting to gain any wealth or fame in return as a reward for practicing generosity. Just as the sun and the moon benefit the world spontaneously and have no concept of "What would be good for me?" in the same way, our genuine bodhicitta is not tainted by the hope for any return. Rather, our mind is imbued with pure wishes to spontaneously benefit all sentient beings.
若果我們對另一位有情眾生沒有憤怒、嗔心,而我們行動的動機是基於菩提心,那在我們感受到威脅時,我們仍然可以得到圓滿正覺,因為我們的行動不受煩惱所染。當我們心識包含著真正的菩提心事時,我們不求回報,譬如是布施後得到財富或聲譽。就像日與月應運地利益這世界,和沒有“什麼能利益自己”的概念;同一方式,真正的菩提心不受回報的慾望所沾染。反而,我們的心識充滿了應運地利益所有眾生的純正願望。

When we are fully awake, mind is free of the object with which it connects to through thoughts, perceptions and feelings. Mind is unobstructed. You neither have a single thought nor many thoughts. Mind does not exist substantially. Mind is no longer ignorant or stupid in the deepest sense. But we should understand that self-realization is not like being in a coma. Instead, there is clarity and power. Self-realized mind is free from the influence of phenomena. It is mind free from all need to occupy itself; it is now an independent mind.
當我們得到圓滿正覺,心識不會受憑著思想、認知和感受所聯繫的對境所牽引。心識是無障礙的。你沒有單一或眾多的思想。心識不會實質地存在。深層裡,心識不再無知或愚蠢。但是我們應該理解證悟不是像昏迷了。反而,那裡有澄明和力量。自覺的心識不受事物的影響。它是一個不需要做作的心識;現在它是一個獨立的心識。

As long as we perceive and experience the various sense objects, but are not self-aware at the same time, we react in a kind of autopilot mode. Such a preoccupied state of mind is actually a kind of stupor or drowsiness, and is based on the ignorance of dense mental states in which self-awareness is lacking. It is an automatically occurring ongoing series of cognitive acts and reactions that take place without our being in touch with the self-reflective, self-aware aspect of our mind. In short, the reflective capacity of the mind that is the basis of wisdom remains inactive. Mental activity that proceeds without our being connected with mind's pervasive self-aware capacity is simply ignorant mental activity. It is a kind of noise that serves to distract mind from its actual nature.

Once training in mindful calm abiding has tamed and pacified the cascade of thoughts, inner images, and emotions, mind's awareness that is aware of itself can emerge on its own accord. In this sense, moments of clarity arise naturally.
經過止定的修持馴服和平息如瀑布般的思想、內在映像、和情緒,心的自覺性能自然流露。在這情況下,澄明的霎那自然生起。
